The wife of Mary Cosby’s son, Robert Cosby Jr., has filed for divorce.

On Monday, weeks after Robert Jr. was arrested for violating a restraining order she filed against him, Alexiana Arian Smokoff, the former partner of the only child of the 53-year-old Real Housewives of Salt Lake City star, filed a petition to end their marriage at the Salt Lake County District Court.

According to PEOPLE, who viewed her divorce documents on November 26, Alexiana’s petition requires that both parties do not “harass, intimidate or disturb the peace of the other party, by any means, including electronically.”

It also says that they should not “commit domestic violence or abuse against the other party or a child, use the other party’s name, likeness, image, or identification to get credit, open an account for service, or obtain a service, cancel or interfere with telephone, utility, or other services used by the other party, cancel, modify, terminate, change the beneficiary.”

Additionally, the petition bans Robert Jr. and Alexiana from terminating any “policy of health insurance, homeowner’s or renter’s insurance, automobile insurance, or life insurance.”

As RHOSLC fans may have seen, Robert Jr. was arrested on November 9 for violating a pretrial protective order, a misdemeanor, and was also charged, via PEOPLE, “with property damage/destruction loss, assault on peace officer or military SVC member in uniform, fail to stop at command of law enforcement, interfering with a peace officer, and criminal trespassing.”

Weeks prior, he was arrested on assault charges after being accused of trying to break into the home of Alexiana’s parents, where she resides, and of assaulting someone on the property. At that time, also per PEOPLE, Robert Jr. was charged with “criminal trespassing, assault, failure to stop at the command of law enforcement and three counts of violating a court order.”

Amid his ongoing legal struggles, Robert Jr., who had a hearing on Tuesday, released a statement through his attorney.

“Today Robert Cosby took responsibility for the mistakes he has made and the pain he has caused his ex-wife and her family,” his lawyer told PEOPLE. “Robert was slow to recognize that his marriage was over. He continued to make contact with his ex-wife in an effort to reconcile. He now realizes that the relationship is over and he must move on.”

Mary spoke to PEOPLE after her son’s first arrest.

“It was for his good,” she reasoned. “I think he needed that. He’s never encountered anything like that. He’s never been through anything like that. I don’t mind it. It hurt me at the time. I was devastated, I was worried, I was scared. But some things happen for a reason to show you the path you’re on. I feel like he needed that and that he understands that that’s the wrong journey.”

Robert Jr. is currently behind bars at the Salt Lake County Jail.
