RHOBH Alum Marcellus Wiley Ordered to Surrender Gun as Judge Orders Annemarie and Him to Go to Mediation Amid Restraining Order Drama

After The Real Housewives of Beverly Hills alum Annemarie Wiley filed for a restraining order and divorce from her estranged husband, Marcellus, after he was arrested, a judge ordered Marcellus to surrender his gun.

When Annemarie filed for the restraining order, she claimed Marcellus kept a Glock 9mm pistol that he possessed in their master bedroom.

According to court documents Us Weekly obtained that were filed on July 7, a judge ruled that Marcellus needed to hand it over. They also noted he was required to show proof that he had surrendered his gun at an upcoming restraining order hearing on July 24. 

Us Weekly also revealed that a judge ordered Marcellus and Annemarie to head to mediation regarding custody of their children. 

“The purpose of mediation is to assist you in developing a parenting plan,” a court order from July 8 reportedly stated.

Before the July 24 court hearing, both Marcellus and Annemarie are required to participate in a mediation session that was scheduled for July 22. 

At that session, a child custody mediator will work to assist the pair in coming up with a parenting plan agreement. 

They were also given the option to resolve their child custody issues online without the assistance of a mediator. These issues include how much time each parent will spend with the children.

If they were to move forward with this option and failed to come to a resolution, they would then be required to participate in the July 22 mediation session.

Annemarie’s temporary restraining order against Marcellus was granted, and he is required to stay away from her and their children until the July 24 hearing about the restraining order.

As previously reported, Annemarie accused Marcellus of rape and abuse in her divorce filing.

In an obtained declaration from Annemarie, she accused Marcellus of a “continuing and escalating pattern of physical violence, sexual abuse, verbal and emotional abuse, financial control and intimidation.”

“Because of the trauma associated with many of these events, there are gaps in my memory, as I have blocked out much of what Marcellus has done to me,” she added, asking the court to require Marcellus to remain 100 yards away from her. 

She also shared that Marcellus had reportedly raped her in 2012 while drunk and attempted to sleep with two of her friends that same year.

Annemarie also alleged that Marcellus punched her in the face, which resulted in a black eye, in 2014.

Additionally, she stated he threw a bottle of Coca-Cola at her head in 2019 when she was nine months pregnant, and that he hit her in the face with a pair of shoes in August 2025.

She also alleged he pulled her out of bed, berated her, and hit her in the head earlier this year.

“He then raped me, telling me that I was his property and that I had to do what he said,” she elaborated, adding that she was raped again later that day and a third time two days later.
