Carmine Agnello, the son of Growing Up Gotti’s Victoria Gotti, missed his deadline to donate his kidney to Victoria by August 3 — before his judge issued a new ruling. Carmine is the grandson of John Gotti, who was the boss of New York City’s Gambino crime family.
In 2024, Carmine pleaded guilty to a COVID fraud scheme involving $1.1 million. Initially, he was set to serve over 33 months in federal prison before the judge started allowing extensions so that he could give the kidney to his mom. Victoria, who suffers from chronic kidney disease, said Carmine is the only match. She’s reportedly called him her “miracle child” and asked the court to refrain from giving him prison time.
According to Greater Long Island, U.S. District Court Judge Nusrat Choudhury gave Carmine two options: donate his kidney to Victoria by Monday, August 3, or go to prison that day to start his 15-month sentence.
The judge’s order gave Carmine only one way to lengthen the reprieve. If he had the transplant on Monday or earlier, Carmine’s self-surrender date would have been delayed to September 18.
But per the New York Daily News, Carmine missed the deadline, despite the judge’s two-month reprieve.
After missing the deadline, his attorney shared in an August 4 court filing that Victoria has a “serious infection requiring a battery of antibiotics.” In an agreement with the judge, Carmine was ordered to surrender himself by August 10 if he didn’t have the procedure by the deadline.
After the judge issued the ultimatum, prosecutors expressed their disagreement. “This is precisely the basis upon which the defendant sought an eve-of-sentencing adjournment in March; and, after obtaining that adjournment, no surgery actually occurred,” said prosecutors at the time. “Needless to say, the government is extremely skeptical of the instant request.”
But Carmine seemed to be taking the procedure seriously, and his attorney Robert Beltrani had submitted documents from two doctors who said the surgery would happen on August 3.
But on August 4, Beltrani said Victoria’s infection triggered “what is expected to be a minor delay in the transplantation.”
“It is nonetheless hoped that she will be cleared for surgery in the coming days and Mr. Agnello stands ready to provide the donation and simply awaits word of a green light for the surgery,” said Beltrani, who has “high hopes” the surgery will occur on August 10.
Beltrani said Carmine will surrender by August 10, but he asked the judge to let him surrender at another date if the procedure can take place beforehand.
“Unfortunately, much to my consternation, the profile of this case would seem to be causing extra delays with the Hospital’s legal department,” said the attorney. The judge hasn’t responded formally to the new request, per AOL.com.
