Denise Richards wants estranged husband Aaron Phypers and his family to vacate their former home.
Amid the couple’s messy split, which has been plagued by claims of physical abuse, drug addiction, and cheating allegations, the 54-year-old Real Housewives of Beverly Hills star has filed documents against Aaron, 52, requesting that he, his brother, and his parents be forced out of the property so she can return and retrieve her belongings.
“When I moved out over two years [ago], I left many of my personal items and my late mother’s items at the house based on Aaron telling me that his family would be moving back to Canada and we would be moving back into the [home],” her court documents read, as reported by Us Weekly on August 20.
Denise’s dogs have also been living at the residence since May, when she underwent a couple of surgeries following injuries sustained during her time filming the third season of Special Forces.
According to Denise, she received a notice from her landlord in June, which stated that he would be starting “eviction proceedings” beginning on August 23, and demanding that the home be emptied. The landlord also reportedly informed Denise that Aaron had not been paying rent and that Aaron had ignored the messages sent to him in regard to the matter.
“Aaron and his parents and brother have severely damaged [the home as it was] in a state of disarray,” Denise wrote, noting that she wants to return to the property to retrieve her items and dogs without Aaron present.
Denise further claimed that she is worried about her things being damaged, as she included photos showing broken flooring, boxes, clothes, and papers strewn around the residence.
In addition to not wanting Aaron home when she returns, Denise also wants to be sure there are no recording devices inside.
In response to Denise’s request, Aaron filed documents of his own, stating that he did not “consent to [the] order requested.”
“There is no emergency or exigent circumstance and the court should deny [her] ex parte request,” he explained.
Continuing on, Aaron said that if Denise is granted the request, he wants the “opportunity to retrieve” his own “personal belongings” from the home where Denise is living.
The Real Housewives of Beverly Hills season 15 is currently in production and expected to premiere later this year or early next year on Bravo.
