Kim Zolciak's Son KJ Jagger's Court Hearing Canceled Suddenly Today as Minor Remains Behind Bars Amid Sexual Assault Charges, Plus His Lawyer Speaks Out

Last month, Don’t Be Tardy alum Kim Zolciak‘s 15-year-old son Kroy “KJ” Jagger Biermann was arrested on claims of sexual battery.

Since being arrested, KJ has remained behind bars with no bond. 

On September 3, Us Weekly obtained a document detailing that KJ was indicted on seven charges.

Specifically, the indictment accused KJ of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under the age of 16.

While KJ was due to appear in court today, Page Six revealed that his court hearing was suddenly canceled, and he now remains incarcerated. 

Jason Sheffield, KJ’s lawyer, confirmed to the outlet that the hearing had been canceled, and he stated that the indictment from September 3 had now become the “controlling action” in the case. Additionally, the judge who was due to oversee the hearing today is now going to be changed.

“Because the State indicted my client, the judge who would have presided over the preliminary hearing today has been divested of that authority,” Jason shared. “We will have several court dates coming up, including a motion to transfer the case to juvenile court, a bond hearing, and an arraignment on the current indictment.”

“Unfortunately, we will have to wait for our day in court where we can finally begin to level the playing field,” he added.

Jason explained that after last week’s indictment, the state had been clear they were intending to try KJ as an adult, which was what was to be litigated at the hearing today. 

“We are expecting to enter not guilty pleas to all charges at the plea and arraignment hearing on October 14,” he said outside of the courtroom. “I’m going to file [a] motion for the case to be transferred to juvenile court and for him to be tried as a juvenile.”

Court documents obtained on August 21 detailed that a sexual assault was reported on April 24 at the North Fulton Hospital, where a girl KJ went to school with, alongside her father, told cops that an encounter with KJ had taken place the day before.

The girl alleged that she and KJ were spending time together at the gym, and the pair went into a co-ed sauna, where she claimed he got handsy. 

She insisted she tried telling him “no” but claimed he wouldn’t stop and forced her mouth onto his penis and digitally penetrated her vagina.

Police reached out to KJ’s father, Kroy Biermann, on May 14, after an investigation, and they ended up speaking with him on May 18. 

During that conversation, Kroy, 40, said he would bring up the matter to Kim, 48. 

KJ has been in custody since August 17.
