Jen Shah‘s attorneys claim the Real Housewives of Salt Lake City star isn’t being treated fairly due to her fame from the show.

After prosecutors lumped Jen into the “Tier A” category, stating she was a leader with “greater culpability” in the alleged telemarketing scheme, her legal team fired off a blistering letter to the court.

In court documents obtained by Radar Online, attorney Priya Chaudhry says prosecutors are simply trying to make an example out of Jen. Furthermore, she’s questioning why the scathing allegations against the reality star were made public in the first place.

“We urge the Court to order it stricken or at least redacted, and to remind the government that it should not file naked statements on the record absent an application for relief or the request of the Court,” Priya wrote, also noting that Jen “has steadfastly maintained her innocence.”

The attorney continued in the letter, “Unlike all of the other defendants, Ms. Shah is a public figure because of her work on the Bravo television network. The government is well aware of this, and timed its letter for the night before oral argument, knowing that it would be picked up by the press—which it was, and was reported in a highly prejudicial manner.”

However, prosecutors aren’t taking the letter too seriously, claiming their latest allegations against Jen have nothing to do with her fame as they’re just stating the facts of the case.

If fans recall, this isn’t the first time Jen’s legal team has attempted to get the criminal charges dismissed. Back in June, her attorneys filed a motion accusing authorities of tricking her into making incriminating statements. But, according to Fox 13 out of Salt Lake City, Judge Sidney Stein not only refused to dismiss the case, but she also upheld the original trial date, which is set for October 18.

Jen is fighting charges of conspiracy to commit wire fraud and conspiracy to commit money laundering after allegedly running a yearslong telemarketing scheme that defrauded thousands of vulnerable victims out of millions of dollars.

Though she has maintained her innocence throughout, she’s facing a maximum of 50 years in prison if convicted on all charges.

The Real Housewives of Salt Lake City season two is expected to premiere on Bravo later this year.
