Former Real Housewives of Atlanta star Kandi Burruss is responding to Todd Tucker and his legal team’s filing regarding challenging their prenup.
Todd, 52, filed a response to Kandi’s divorce filing on November 26, requesting primary custody of their two kids and questioning the enforceability of their prenuptial agreement because his attorney was not present when he signed it.
According to US Weekly, Kandi, 49, amended her divorce petition on December 1 to respond to her estranged husband. To start, Kandi states that Todd had high-powered legal representation throughout the process of putting together the prenuptial agreement.
Per Kandi’s filing, “The parties’ journey to executing an enforceable Prenuptial Agreement was filmed and broadcast on Bravo television network, with the knowledge and consent of both [Burruss] and [Tucker], for their five-part reality television wedding documentary entitled Kandi’s Wedding that premiered on June 1, 2014.”
The RHOA alum and her legal team also note that Todd “audibly announced” that he was “good to sign” the documents. They also said that Todd spoke to his attorney “on and off camera.”
In the midst of their divorce, footage from Kandi and Todd’s Bravo special of them arguing over the prenup has resurfaced. It begins with Kandi saying to Todd, “Just letting you know, they have suggested that we call our wedding off.”

He then said, “It’s sounding like either you sign this sh** or ‘I don’t want to marry you.’ That’s not fair. Let’s talk.” From there, Kandi asked Todd what needs to change about the prenup, and he said it needs to “become a proper document.” They then tried to call his attorney, but the call went unanswered.
The hypothetical of Todd becoming sick or disabled during the marriage then came up, and how there were no provisions about it in the agreement. Todd called the document “so business” and said that “Kandi hadn’t really reviewed it.”
Later, Todd brought up the stipulation from the prenup that stated that he’d need to move out within 30 days if they broke up. Kandi then agreed that he could move to the guest house until he found a new home.
Of course, Kandi also addressed Todd’s request for primary physical custody of their two children, in which he cited her busy work schedule that often requires travel.
While she was initially requesting joint legal and physical custody, this has now changed to sole physical custody. Her lawyer noted that both Kandi and Todd are “public figures and self-employed entrepreneurs.” Additionally, the filing said that she pays for a nanny whenever either of them has to travel for work.
Per the filing, “Both [Burruss] and [Tucker] have held professional obligations that have required each party to travel away from the home for extended period of times, independently and jointly, prior to and after the births of both of the minor children.”
The legal motion went on to describe the support system she has in place outside of the nanny. They wrote that it’s a “diverse and concentrated family support network, which includes maternal grandparents, aunts, uncles, and cousins within a five to 20-mile radius of the family residence.”
