Police Report Reveals New Details on Kim Zolciak's Son KJ Biermann's Arrest as Lawyer Speaks Out and Insists He is 'Innocent'

Fans of The Real Housewives of Atlanta and Don’t Be Tardy were stunned yesterday when it was reported that Kim Zolciak‘s 15-year-old son, Kroy “KJ” Jagger Biermann was arrested on claims of sexual battery.

While some details regarding the allegations were revealed when the initial news came out, a newly released police report offered more information.

Us Weekly obtained the report, which detailed that the alleged incident took place on April 23 at Lifetime Fitness in Alpharetta, Georgia.

It noted that a female victim, who the outlet did not identify, reported an aggravated sexual battery and aggravated sodomy and ended up being taken to the hospital. 

She claimed she had a chiropractic appointment at the gym, but found out her chiropractor was not in the office that day and decided to work out. While eating in a café the gym has, she said she saw KJ, a friend of hers, come into the gym and called out to him. They began talking, and she alleged KJ “asked if she wanted to go into the coed sauna with him.”

The alleged victim noted she and KJ had been “friends for some time” in high school and called him “flirty” and a “joking person.”

She stated KJ “was making jokes and flirting” with her as they made their way to a family locker room. Once there, she alleged he tried to kiss her multiple times. 

“He grabbed her by the waist and started kissing her neck and grabbing her butt with his hand and an open hand and kissed her lips,” the report stated, noting that KJ also touched her private area on the outside of her pants, and the girl “froze.”

The police report went on to share the girl told KJ “no” multiple times during the alleged incident, and that he allegedly “said something to the effect that she was lucky he wasn’t making her do it.”

He then allegedly pulled down his pants, exposed his penis, and put it in her mouth. 

The girl claimed KJ “tried multiple times to have sexual intercourse with her by trying to pull down her pants.”

She also noted that there was “nowhere for her to go, that he had pulled her towards him, always keeping his hands on her body” and claimed he “slipped his hands into her shorts.”

While she said she “kept trying to get away,” she shared she “eventually succeeded” and said that KJ then pulled up his pants and left the scene.

The girl ended up going to school the next day, but departed after she saw KJ’s girlfriend and ended up telling her grandma what allegedly happened at the gym. She also admitted to the police she had previously kissed KJ “consensually.”

According to the cops, KJ and the alleged victim were seen on surveillance video from the gym both going into the family dressing room. Approximately 20 minutes later, the girl left the dressing room and headed toward the lobby, while KJ went to the sauna alone. 

Tests were conducted, and the results concluded there was no presence of male and human DNA in the victim’s private area and mouth.

Jason Sheffield, KJ’s attorney, spoke to Us Weekly about the ordeal in an earlier statement. 

“First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles,” he said. “Secondly, my client is 100 percent innocent and tried to present evidence to the arresting officer, including a passed polygraph by a notable and respected sex offender polygrapher.”

“Additionally, the officer’s report notes the GBI [Georgia Bureau of Investigation] found no male DNA on or inside the areas the alleged victim claimed she was assaulted. Had the officer sat down with me, I feel certain she would’ve never made an arrest,” Jason added.

KJ is currently being held at the Metro Regional Youth Detention Center, and a bond for him was not set. A preliminary hearing has been scheduled for September 8.
