Despite her alleged admission to her probation officer last month that she consumed alcohol, Luann de Lesseps appears to be backtracking and is now asking for proof that she violated her probation.
The Real Housewives of New York City star is asking a Palm Beach County judge to turn over any evidence against her, including evidence that claims she failed a drug test.
If you recall, Luann’s probation officer filed a report in April stating Luann had failed her sobriety test that month and admitted to them that she had consumed two mimosas after a performance in Chicago. Following that report, Luann released a public statement.
“I take my sobriety very seriously and like many in my situation, it is a daily struggle,” Luann revealed at the time. “I remain committed to doing whatever it takes to continue living a healthy sober lifestyle.”
Fast forward to now and PEOPLE is reporting that Luann wants copies of the prosecution’s evidence in the case against her, including police reports, witness statements, testimonies, or expert statements that point to her violating her probation.
In addition to her alleged failed sobriety test, Luann was also accused of violating her probation when she reportedly didn’t complete her AA meetings. The Florida Department of Corrections noted that they had not received sufficient evidence to prove that she had completed what was required of her.
Luann’s rep didn’t comment on the situation, but Luann is scheduled to appear in court on Thursday, May 23.
“I am looking forward to my day in court to present evidence clarifying these allegations,” she previously told TMZ.
Prosecutors had previously offered her two options upon learning that she allegedly violated her probation – wear an ankle bracelet or immediately enroll in outpatient treatment. Luann reportedly refused both options.
Luann agreed to a plea deal back in August of last year, which put her on a one-year probation term. This probation required her to complete 50 hours of community service, attend two AA meetings per week, and not consume or possess alcohol or illegal drugs. Luann was also required to attend a Victim Impact Class by Mothers Against Drunk Driving.
The plea deal was a result of her December 2017 arrest for attacking a cop, after which she pled guilty to felony charges of battery, trespassing, and disorderly intoxication.
