Erika Jayne is refusing to turn over a pair of diamond earrings given to her by her now-estranged husband, Thomas Girardi, during their marriage.
In a recent motion filed by the trustee presiding over the former attorney’s bankruptcy proceedings, it is noted that while it has reportedly been confirmed that Thomas purchased the jewelry using his clients’ settlement funds, the Real Housewives of Beverly Hills star isn’t ready to give them up.
On January 25, Radar Online revealed that in the year since Thomas was forced into Chapter 7 bankruptcy, the trustee has learned he owes $101 million to various creditors and determined that he bought Erika the earrings for $750,000 from M&M Jewelers with funds from Girardi Keese’s client trust account after reviewing statements and financial records.
While the earrings are now estimated to be worth around $1.4 million, Thomas allegedly did his best to hide the misappropriating of his clients’ funds by “describing the purpose of the check” as a “cost” item.
“Erika has no legal or equitable right to the Diamond Earrings and the same are legally and equitably valuable assets of the GK Bankruptcy Estate that the Trustee can and should sell,” the trustee’s documents explained.
According to the motion, the trustee is demanding Erika return the earrings and asking the court to order her to turn them in within five days.
The motion also requests the RHOBH cast member be banned from selling the earrings or giving them to someone else. But, thus far, she has not handed the jewelry over, nor has she responded to the motion in court.
Erika is currently in production on the upcoming 12th season of The Real Housewives of Beverly Hills, which includes not only the entire cast of season 11, including Kyle Richards, Lisa Rinna, Dorit Kemsley, Garcelle Beauvais, Sutton Stracke, Crystal Kung Minkoff, but also two new wives, including full-time cast member Sanela Diana Jenkins and part-time star Sheree Zampino.
