Don’t Be Tardy alum Kim Zolciak‘s 15-year-old son Kroy “KJ” Jagger Biermann Jr. has been under the microscope since he was arrested in August after he was accused of aggravated sodomy and aggravated sexual battery.
While he was released from jail and began house arrest at Kim’s home, there haven’t been any updates to the case until this morning.
According to Page Six, KJ officially pleaded not guilty to the seven felony charges in his sexual battery and sodomy case. These charges included aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment, and three counts of aggravated sexual battery against a child under 16.
Jason Sheffield, the lawyer representing KJ, filed the documents in court on Monday and informed the presiding judge that KJ was pleading not guilty to all counts in the Georgia grand jury indictment.
He also shared that KJ had waived a formal arraignment that was scheduled to take place next Wednesday, and he requested that a date be set for a hearing for KJ’s case to be transferred to juvenile court before pre-trial and trial dates were set in superior court.
The judge also approved the seal of documents in three “envelopes,” though, as Page Six noted, the filing did not explain details surrounding the documents and envelopes.
TMZ initially obtained court documents from August 21, in which it was revealed that a sexual assault was reported on April 24 at the North Fulton Hospital, where a girl KJ went to school with, along with her father, told police that an encounter with KJ had taken place the previous day.
The girl claimed that she and KJ were spending time together at the gym, and they eventually ended up going into a co-ed sauna, where she alleged he got handsy.
While the girl noted she tried to tell KJ, “No,” she shared he wouldn’t stop and allegedly forced her mouth onto his penis and digitally penetrated her vagina.
After an investigation, law enforcement reached out to KJ’s father, Kroy Biermann, on May 14 and spoke with him on May 18.
Kroy, 41, shared that he would discuss the issue with Kim, 48.
The police report noted that the girl did end up getting examined at a hospital, but doctors did not find any male DNA in her mouth or vagina.
On August 17, KJ was officially taken into custody, and on August 21, Kim gave a statement to Us Weekly defending her son.
“The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” she shared at the time. “My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found.”
“False accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation,” Kim added. “We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”
To date, Kim and her family have not commented on KJ’s not guilty plea.
