Judge Warns Erika Jayne Not To Sell Frozen Assets Or Community Property Amid Husband Tom Girardi's Involuntary Bankruptcy, Plus RHOBH Star is Spotted Without Her Wedding Ring for First Time Since Divorce Filing

Erika Jayne‘s attorney appeared in court on her behalf on Tuesday, December 22, and during the hearing, a Chicago judge made it clear that her estranged husband Thomas Girardi‘s assets were frozen “without question.”

As Edelson PC continues their search to find the $2 million the Real Housewives of Beverly Hills cast member and her ex-spouse are accused of embezzling from families of victims of a 2018 plane crash in Indonesia, attorney Matthew Wasserman promised to relay the information while also revealing how Erika learned Thomas’ assets had been frozen.

According to a report from The Chicago Sun Times, U.S. District Judge Thomas Durkin told Erika’s lawyer that Thomas’ “assets, without question, are frozen right now.”

“So I think you need to convey that to your client,” he added.

In response, Matthew agreed to do so and claimed the RHOBH star only knew that Thomas’ assets had been frozen because her divorce attorney informed her of the update through an email.

“I question whether she’s subject to this court’s jurisdiction,” he also said.

While the judge did have a message for Erika, he didn’t take any other legal action against her.

Last week, after seeing that Erika shared a tweet that included a link to buy her clothing online, Edelson PC attempted to stop her from selling her designer items and told a judge she should be forced to turn over any of the money generated from the sales.

“Simply put, the court froze all of Tom Girardi’s assets, and that means all community assets are frozen too,” their motion stated, via a separate report from the Chicago Tribune. “Erika Girardi must stop selling her clothes.”

However, on Tuesday, after an involuntary bankruptcy filing was made against Thomas and his firm, Girardi Keese, Edelson PC withdrew their motion.

Still, the judge said at the hearing that Erika should not be selling anything that Thomas may have ownership of.

“Apparently these are clothes she is selling that belong to her. I don’t know whether assets she is selling are considered community property [but] if she’s selling assets that are property of Thomas Girardi, either whole or in part, you need to inform her of the danger that puts her in,” he informed her attorney.

In Edelson PC’s $2 million lawsuit against Erika and Thomas, they accused the couple of leading “opulent” and “notoriously lavish lifestyles,” giving a nod to Erika’s admission to a $40,000 glam budget.

“Erika even performs a song called ‘Exxpen$ive,’ featuring the hook ‘it’s expensive to be me,’” the lawsuit stated.

The company also slammed Erika’s divorce filing as a “sham proceeding,” claiming the reality star is only “splitting” from Thomas in an attempt to shield their assets from creditors.

“Erika Girardi could not be more closely associated with Tom Girardi. The property she is attempting to sell likely belongs, in part, to Tom Girardi,” Jay Edelson said in a statement last week.

In other RHOBH news, Erika was recently spotted without her wedding ring in Los Angeles.

According to a Page Six report on December 22, Erika’s left hand was in clear view and showed no signs of her ring when she left the home of her co-star, Kyle Richards, on Monday.

Erika was also spotted out in Los Angeles at the end of last month, where she didn’t appear to have on her ring.
