The family of Erika Jayne‘s estranged husband, Thomas Girardi, has filed for a conservatorship amid his ongoing legal and financial woes.
After the attorney, who was made famous by the 2000 film Erin Brockovich, was forced into bankruptcy and accused of stealing millions from clients, his brother, Robert Girardi, has claimed in new court documents that Thomas, who has been seen on past seasons of The Real Housewives of Beverly Hills, is no longer able to care for himself.
In a declaration obtained by The Blast on January 20, Robert has requested control of Thomas’ estate be given to his family and noted that the attorney’s condition has deteriorated to the point that he now struggles to remember times, dates, and places.
“Thomas V. Girardi (“Tom”) is a renowned trial lawyer, responsible for some of the most notable mass tort verdicts in California. However, at age 81, Tom’s current condition has sadly deteriorated to the point where he cannot care for himself without assistance. His short-term memory is severely compromised and, on information and belief, he is often not oriented as to date, time or place,” Robert wrote, adding that he “has first-hand knowledge that Tom lives alone and can not care for himself.”
According to Robert, Thomas could lose vital employees because of his dire financial state, including his housekeeper, who has handled his groceries for decades.
“For at least 25 years, Tom has employed help to assist him with day-to-day functions,” Robert wrote.
Although Thomas currently has “certain friends looking out for him to make sure he has sufficient food and that he makes it to a given appointment on time,” Robert believes he would be unable to maintain his day-to-day activities if he were to be left alone.
Robert also said that because of his mental state, he does not believe Thomas is able to “resist fraud or undue influence.”
While the RHOBH star and performer was listed as Thomas’ spouse in Robert’s court documents, the couple is in the midst of a divorce, and it’s not yet known if she would sign off on the conservatorship.
The Real Housewives of Beverly Hills season 11 is currently in production and expected to air on Bravo sometime this spring.
