The Real Housewives of Orange County newbie, Gina Kirschenheiter, failed to show up to her court hearing regarding a restraining order against her estranged husband, Matthew Kirschenheiter, on Tuesday.
Gina, 35, initially filed for a temporary restraining order after Matt allegedly assaulted her and threatened to kill her back in June. And during yesterday’s hearing, a judge admonished the attorney for the RHOC star after she missed the court date.
However, OK! Magazine is reporting that the mother of three had a legitimate reason as to why she skipped out on the Orange County Superior Court hearing.
“The reason why Gina was a no-show was because she was under the impression that they agreed to continue the date on the protective order issue,” explained Tracey Lundquist, Gina’s lawyer. Matt, however, was in attendance.
As a result, Gina’s restraining order has been extended until August 14th, the day they’re both due back in court. According to the report, Gina will be requesting a permanent restraining order of five years. During that time, Matt will continue to be allowed supervised visits with their three children.
But Matt’s lawyer, Haylee Rosen, says the father of three “would prefer to have unsupervised visits.” The lawyer states that since Gina is in New York with the kids, Matt wishes to visit the children unmonitored there. No official arrangements have been made, though.
“My client has never been arrested, let alone convicted of anything. He has no DUIs. I think the mother doesn’t have a driver’s license anymore. He’s a great and devoted father to his children, whether it’s here in California or New York,” Matt’s lawyer continued.
Devoted father or not, court hearings aren’t the only thing Matt has to worry about these days. After his arrest, the estranged RHOC husband was reportedly fired from his job at the investment management firm, PIMCO, according to Radar Online.
A source there revealed that Matthew was “devastated and does not know how he is going to provide for his family.” If you recall, the reason Matt did not appear on the RHOC last year, during Gina’s first season, was reportedly because his job wouldn’t allow it.
Between the restraining order and her own legal issues consisting of a recent DUI, Gina sure does have a lot on her plate. And we’ll likely see a lot of it play out in the upcoming season of the show.
