RHOC's Tamra Judge Files Lawsuit Against Insurance Company for Failing to Defend Her Against Jim Bellino's $1 Million Defamation Case

Tamra Judge has filed a lawsuit against her insurance company after they failed to cover her legal bills amid Jim Bellino‘s $1 million defamation case against her.

According to a new report, the Real Housewives of Orange County cast member filed a lawsuit against Encompass Insurance Company on July 10, 2019, claiming the company was in breach of contract when they refused to cover claims made in regard to Jim’s lawsuit.

In her complaint, which was obtained by Radar Online on July 29, Tamra claimed she was covered under a policy with Encompass at the time Jim filed his defamation lawsuit against her, which would require the company to pay her legal bills.

“Encompass is obligated to provide a defense for Plaintiff in the Bellino action,” she claimed in her affidavit. “Defamation is a specifically listed offense for which Encompass stated that it would provide a defense. Nonetheless, Encompass erroneously denied a defense to Plaintiff.”

While the company denied the claims she attempted to make, Tamra said their denial was without base.

“Encompass basis for its denial is absurd and based on an exclusion that it knows is (sic) completely inapplicable to the facts of the Bellino action. Encompass at all times looked out for its own interest ahead of that of its policyholder. As a result of Encompass’s bad faith handling of Plaintiff’s claim, and its failure to provide Plaintiff with a defense, Plaintiff is forced to pay for her own defense when Encompass knows fully that the obligation to defend rests with it,” she explained.

“In addition, Plaintiff has been forced to brig the instant action to get Encompass to do what it is legally obligated to do in the first place, to wit, defend the Bellino action,” Tamra added.

Tamra is suing the company for compensatory, general, and punitive damages. She’s requesting that her attorney’s fees and the cost of the case be paid for.

In September of last year, after Jim accused her and Shannon Beador of defaming him on Heather McDonald‘s podcast, Juicy Scoop, Tamra requested Jim’s case against her be dismissed. Months later, Shannon was dismissed from the case while Jim’s lawsuit against Tamra remained active.
