Kenya Moore accused Marc Daly of being an absentee father in recently-filed court documents as she fired back at his suggestion that she should be held in contempt of court for a series of scenes on The Real Housewives of Atlanta.
As she maintains primary custody of their four-year-old daughter, Brooklyn, with Marc having visitation, Kenya was forced to defend herself against her estranged husband, who accused her of violating a court order that required her to inform him of when their child would be appearing on the Bravo reality show.
According to court documents obtained by Radar Online on July 25, Marc claimed Kenya failed to tell him she filmed a Home Run Inn Pizza ad with their child, and that Brooklyn was present when Marlo Hampton tried to kick in her hotel door.
Although Marc, who is based in New York, initially opposed Brooklyn filming altogether, she pointed out that her role on RHOA required her to include her full life, and ultimately, a judge ruled that Brooklyn could film, but that Marc had to be informed of when she’d be on camera.
“[Kenya] shall notify [Marc] of any opportunity where the minor child will appear on camera and shall advise [Marc] of the content of the appearance; the minor child will only be involved in opportunities that are age appropriate,” a motion read.
But after Marc’s claims against her, Kenya said in her own documents that he was aware of her commercial with the pizza company and “consented to” it, and she denied any violations.
She also said Brooklyn was “never seen on camera, and the minor child was not even aware that someone was at the hotel door.”
“The door that was kicked was the living room door of a parlor suite, wherein the minor child was in the bedroom,” her documents explained, adding that she would “have no reason to know that someone would kick her door, but immediately addressed the situation and the parties left without any further provocation.”
In addition to accusing Kenya of being in contempt of court, Marc said in his court documents that he “repeatedly requests calls and FaceTime with [Brooklyn], and provides available times,” but Kenya ignores him and refuses to “cooperate with in-person visits.”
He even said he spoke to Brooklyn just two times in June. However, in her rebuttal, Kenya shaded Marc for his lack of involvement with the child and accused him of inconsistency.
“[Marc] began to erratically change the times that he wanted to call on a whelm. He did this for the purpose of attempting to create an issue,” she alleged. “Mother has implored Father to be consistent with his calls, which he refuses to do. Nevertheless, Father has been random in his behavior and unwilling to stick to the established schedule.”
“The evidence will show that Father is simply a ‘FaceTime’ father, who is inconsistent with even talking to his child at best. He doesn’t visit her, makes promise to her that he does not keep, and continues to disrupt the normalcy that Mother has strived so very hard to provide for the minor child,” her motion read. “For example, Mother planned (with Father’s consent) a trip to Disneyland, Father committed to coming, causing Mother to pay for the costs of travel for he and the child, and the cost of lodging for everyone. Father, after committing to show, failed to show up, disappointing the child who was excited with anticipation of seeing him, and costing [Kenya] thousands of dollars.”
As Marc insists that Kenya is to blame for his lack of contact with Brooklyn, she told the court that he only found “interest in his child” after requesting he film with her to showcase their “relationship.”
Meanwhile, in another set of court documents shared by Radar Online on July 26, Kenya said that despite visiting Atlanta twice, he did not visit with their daughter.
Kenya “actually paid for and traveled with the child to New York on the two occasions where [Daly] did see the child,” the documents revealed. “The Father has only seen his child twice in two years. In both instances, the mother, on her own expense, took the child to see the father.”
Also in her court documents, Kenya said she has “made multiple good faith attempts to reach a settlement” with Marc, but that Marc is “intentionally hindering the divorce proceedings.”
She then requested he pay her court fees.
Kenya and Marc are headed to a divorce trial in the coming weeks.
