RHOBH's Erika Jayne Appears in Court to Address Bankruptcy Case as Trustees Attempt to Sell $16 Million Pasadena Mansion, Claims "Marital Interest" in Home But It's Not in Her Name

Erika Jayne appeared in court this week, through counsel, to address the ongoing bankruptcy proceedings against her and her estranged husband, Thomas Girardi.

As trustees prepare to sell off the former couple’s $16 million mansion in Pasadena in an attempt to pay back his creditors and former clients he wronged, The Real Housewives of Beverly Hills cast member objected to the potentially upcoming sale of the home while requesting $600,000 in exemptions.

“BREAKING: FINALLY, Erika Girardi appears in the bankruptcy case through counsel to object to the sale of the house without giving her estate $600,000 in exemptions. This is huge news,” attorney Ronald Richards tweeted on March 23. “Now she is subject to the Court’s jurisdiction and discovery.”

The attorney went on to say that the RHOBH star’s request was quite odd, especially considering the fact that her name is not actually on the home she and Thomas once shared.

“It is incredible that her 1st words legally since this all started is I want my $600K exemption carved out of any motion,” he wrote in a second tweet. “The house is not in her name. This will throw the settlement into a contested proceeding for sure.”

Ronald then noted that Erika is claiming a “marital interest in the home” and revealed that the motion points out that her and Thomas are still in the midst of a divorce.

After being accused of embezzling millions from his former clients, and of stiffing a number of other creditors along the way, Thomas was placed under a conservatorship as he claimed to be mentally incompetent.

Then, a short time later, after Thomas was said to be suffering from late onset Alzheimer’s disease in February, the State Bar in California admitted they were suspicious and announced plans to file charges against him.

While Erika hasn’t yet addressed the legal drama publicly, Andy Cohen confirmed she was “talking” amid production on RHOBH season 11 while appearing on the B*tch Sesh podcast.

“This is what you have to know: we started shooting Beverly Hills and everything was kumbaya. This all happened when we were shooting. She continued shooting.”

The Real Housewives of Beverly Hills season 11 is expected to premiere this spring or summer on Bravo.
