Jay Edelson, the founder of Edelson PC and one of the many people currently suing Thomas Girardi and his estranged wife, Erika Jayne of The Real Housewives of Beverly Hills, spoke out about his case against the ex-couple while appearing on a podcast on Wednesday.
After The Housewife and the Hustler gave a nod to the $2 million embezzlement case he filed against Thomas and Erika at the end of last year, Jay suggested Thomas has been stealing money from his clients for years before sharing his views on Thomas’ Alzheimer’s diagnosis and the “victim” image Erika has been portraying to the public.
“Tom has been stealing money from clients for apparently decades and a lot of money,” Jay said on the June 16 episode of the Reality Life With Kate Casey podcast. “And so then the next question is, ‘Why?’ And the reason is because of the incredible amount of influence he had.”
“We decided to file [our lawsuit] because Erica filed for divorce. When she filed for divorce, we [realized] that she probably was doing that because the money was gone,” Jay explained. “The theory of our case is that she was basically taking client funds and using it to fund her lifestyle. And if we’re successful in [proving] that, that means that we’re going to be able to get whatever possessions she has back in order to pay off any sort of judgment.”
She has also been trying to portray herself as an innocent spouse of Thomas. But, as Jay told Kate, he plans to prove that she was very much involved in both his borrowing and his alleged transferring of misappropriated funds.
“He was loaning money to her [entertainment] company, 10s of millions of dollars to her company, and we think that money came from client funds. We’re going to look into all of that and that’s all going to be [part of the proof we present] to a jury that she was knee-deep in this fraud,” he vowed.
Although Erika has suggested that only Thomas knows about the supposed crimes he has committed over the past several years, Jay doesn’t believe she was one of his victims. Instead, he feels that she actually “played him.”
“I mean, how much money did she get from him to further her career? Money which he didn’t even have. So, I don’t view her as a victim. She was kind of conning the con man,” he noted.
After several lawsuits were filed against him at the end of last year, including Jay’s, Thomas was placed under the temporary conservatorship of his brother, Robert Girardi, and he was diagnosed with Alzheimer’s disease. Right away, Jay was skeptical.
“It seemed very convenient,” he stated.
After all, at the end of last year, prior to the diagnosis, Jay had communicated with Thomas.
“It did not feel to me like our speaking was to someone who was mentally incapacitated,” he stated. “He was speaking at lawyer events right before the lawsuit. There’s some on YouTube and then some that were separate where he was the same old Tom [five or 10] years ago. So this all just feels like kind of crap to me.”
Jay also said that during his negotiations with Thomas, Thomas attempted to “bribe” him.
“[He] basically told us that he has a very close connection with judges, and he can make us another million dollars,” Jay revealed.
As for what’s next, Jay said he and his team will soon be getting into depositions.
“And that’s where really the fun happens. We’re going to be deposing some of Tom’s former partners. And we expect to be deposing Erika as well, and Tom and that’s where the rubber meets the road. She can say whatever she wants on her reality show, but when she’s under oath, we’re going see a totally different Erika Jayne,” he teased.
