RHOBH Star Erika Jayne's Husband Thomas Transferred to "Restricted Memory Care Unit" as Attorney Confirms Ongoing Decline of "Memory Functions"

The health of Erika Jayne‘s estranged husbandThomas Girardi, is reportedly deteriorating amid their ongoing legal drama.

As bankruptcy proceedings continue against Thomas, 83, both personally and with his defunct law firm Girardi Keese, an insider claims the former attorney, who was officially disbarred earlier this year following numerous violations of ethics rules and laws, has been transferred to a “restricted memory care unit” at an assisted living facility in Orange County, California.

In court documents obtained by PEOPLE on October 18, Thomas’ attorney, Rudy M. A. Cosio, said he was relocated “due to a further decline in his memory functions.”

As Real Housewives of Beverly Hills fans will recall, Thomas was diagnosed with late-onset Alzheimer’s in March 2021 and began living at a 24-hour care center in July of that year. Amid the diagnosis, which was questioned by many, Thomas was placed under a temporary conservatorship that has since been made permanent.

During a prior visit to the restricted memory care unit, Thomas’ attorney said he “appeared neatly dressed and well groomed” and confirmed that he was “well treated” at the facility. However, because Thomas has moved out of Los Angeles and headed south, the attorney is requesting future conservatorship hearings be moved from L.A. to Orange County.

While appearing on Watch What Happens Live in May, Erika, 51, briefly spoke about Thomas, telling host Andy Cohen that when it comes to his condition, he is not expected to improve.

“Tom lives in a memory care facility. Look, I can only say decline and further decline, it will not get better,” she explained, adding that while Thomas contacts her frequently, their calls only last “about five seconds.”

Also during the episode, Andy asked of Thomas’ legal situation, “Does he know that the chickens have come home to roost?”

“He thinks he’s still practicing law,” Erika replied.

In addition to the many lawsuits Thomas is facing, Erika has been dealt with plenty of cases herself. That said, while appearing at BravoCon over the weekend, Erika shared good news.

“It’s never really stopped because the turmoil in my life got heavier … [But] I’m winning,” she declared. “I’m doing really well, and I’m very pleased about that because once all this started, all I asked for was time … So two years now down the road, we’re doing great things, and I’m grateful for that. I have more to go, but I’m in a much better place.”
